Standard Terms
Personal Information
We
collect your personal information to manage our business relationship
with you, as well as that of our authorized service providers. We will
not knowingly share this information with third parties without your
consent, except as needed for service providers, credit information
providers, parties involved in transferring or managing this Agreement,
or as outlined in our Privacy Policy, which is available at
appliancerepairexpert.ca/privacy-policy/ or by contacting our Privacy
Officer.
By accepting this, you: (i) consent to the collection,
use, disclosure, and maintenance of your personal information and to
receiving commercial electronic messages and promotional offers (such as
home or business efficiency tips, special discounts, and updates on
products and services) in line with our Privacy Policy. You can opt out
at any time by contacting our Privacy Officer using the information
below; (ii) authorize us to use and disclose your personal information
to: verify your identity when you inquire about your account via phone
or email; bill, collect payments, manage your account, and/or provide
services under this Agreement; review your payment history; share
information with our authorized technicians and other service providers;
comply with law enforcement and legal obligations; handle overdue
accounts referred to a collection agency; and perform a credit check,
with all results and other personal information handled according to
applicable laws and our Privacy Policy. We may record phone
conversations with you and share these recordings for the purposes
outlined in this section.
You may reach our Privacy Officer with
any questions or concerns regarding the Privacy Policy, how your
information is managed, or to request revisions or removal from our

Technician Safety
No
service or repairs under the Membership Plan will be performed if our
authorized technician refuses to enter a residence due to the presence
of animals, insects, unsanitary conditions, or other safety concerns, or
if the equipment is not easily accessible. In the event of such
conditions, as reasonably determined by us, we reserve the right to
terminate your Membership Plan at our discretion.
Governing Law
These
General Terms and Conditions are governed by and construed in
accordance with the laws of Ontario and the applicable federal laws of
Canada.
Entire Agreement
These General Terms and
Conditions, including any supplementary terms, welcome letters, renewal
letters, and completed enrollment forms, constitute the entire agreement
between you and us, superseding all prior agreements, whether oral or
written. No warranties, representations, or other agreements exist
except as specifically outlined herein.
Conflict
In the
event of a conflict or inconsistency between the information on the
enrollment form and this Membership Plan Guide, the terms of this
Membership Plan Guide will prevail to the extent of such conflict or
inconsistency.
Assignment
We may assign any or all of
our rights and obligations under this Membership Plan Guide or use it as
collateral for any obligation without your consent. If you wish to
assign this Agreement to another party, our written consent is required.
Notice
We
may provide notice to you via personal delivery, mail (including
registered mail), phone, or email. If your email address changes, you
must provide us with the updated information.
Force Majeure
We
are not liable for failure to fulfill our obligations or for any loss
under this Membership Plan Guide if such failure is caused by events or
circumstances beyond our control.
DIAGNOSIS, LIABILITY, AND WARRANTY
Diagnosis
We will diagnose and repair your equipment according to the terms of your Membership Plan, provided that the appliance is:
Located within the permanent foundation of your residence;
Properly installed and functioning as of the Coverage Date;
Easily accessible and safe for our authorized technician to diagnose and repair;
Situated in a safe and sanitary environment.
Liability
While
we strive to diagnose and repair issues on the first visit, it is not
always possible. We are not liable for any losses or damages resulting
from misdiagnosis or delays in completing repairs. If we fail to correct
or repair a problem covered by your Plan, or if a replacement part
fails, our sole obligation is to correct the issue and, if necessary,
provide an additional replacement part.
We are not responsible
for indirect, consequential, or economic damages, nor for losses or
damages to persons or property arising from the use or inability to use
the equipment, to the extent permitted by law. We also do not cover
defects that are subject to manufacturer or distributor recalls, in-home
warranties, or are covered under manufacturer, distributor, or builder
reimbursement programs.
Pre-existing conditions or defects that existed prior to enrollment are not covered.
Unavailable Parts or Non-repairable Appliances
We
make every effort to locate replacement parts or suitable alternatives
as quickly as possible. However, limited availability of certain parts
may result in delays. If a part is no longer available or cannot be
obtained at a commercially reasonable cost, we are not responsible for
replacing the equipment. If the part is unavailable or the appliance
cannot be repaired, either party may terminate the Membership Plan.
Warranty
We make no representations or warranties as to the parts and labour, except those given by statute, except as provided below.
EXCLUSIONS
General
Exclusions: Your Membership Plan specifically does not cover any
equipment used for commercial or other non-residential use or any costs,
including diagnosis and service, repair, parts replacement, or
adjustment if the equipment was used for commercial applications. Costs
will further not be covered if repairs are needed because of: design
faults or faults which existed before your Membership Plan became
effective, abuse, tampering, alterations or repairs by persons other
than us, accidental or deliberate damage, loss, theft, freezing weather
conditions, subsidence, structural repairs, fire, lightning, explosion,
earthquake, flood, storm, acts of war or other insurable risks, the
thermostat is not at the proper setting, the household electrical fuse
or breaker required for the equipment is blown, improper sizing or
application of the equipment, redecoration or renovation related work,
pre-existing defects or deficiencies in existence or which have
previously been repaired during the first 30 days prior the date of
coverage under your Membership Plan, lack of reasonable maintenance,
heating, cooling, appliance, electrical or plumbing or drains system
breaking down.
Your Membership Plan does not allow to apply coupons code for repair and installation service.
Your
Membership Plan 20% discount is only applicable for repair service and
doesn’t apply for any installation service provided by our Technician.
Equipment not Readily Accessible by an Authorized Technician
Circumstances,
where appliance is not readily accessible for an authorized technician,
include, but not limited to, instances where your appliances are
located in a crawl space, attic or an area where an authorized
technician cannot safely or easily access them. In such instances, we
will not provide service and will deem your appliance ineligible for
service. If one of our authorized technicians deems your equipment
ineligible for service under the Membership Plan, we will terminate your
Membership Plan.
OUR REFUND POLICY
Cancellation
within 10 Days – If you decide to cancel your Membership Plan within 10
days and have not used any services during this period, we will refund
any payments made. If services have been used within these 10 days, your
Membership Plan will be terminated, and we will refund the payments
made, but you will be charged for the services rendered.
Equipment
Not Eligible for Service – If our authorized technician determines that
your equipment is not eligible under the Membership Plan coverage, and
no services have been completed under your Membership Plan, we will
refund any payments made. However, you will be billed for any service
that has been provided.
MODIFICATION OF TERMS AND CONDITIONS
We reserve the right to modify these terms and conditions, including pricing.
